If your organization has 20 or more employees at any point during the previous calendar year and provides group health coverage benefits (e.g., employer-provided health insurance, health care flexible spending accounts or health reimbursement arrangements), it may be subject to the Consolidated Omnibus Budget Reconciliation Act of 1985 (COBRA).

COBRA mandates the continuation of group health coverage benefits that might otherwise have been terminated. COBRA extends to former employees, their spouses and legal dependents the right to temporary group health coverage at group health rates. COBRA also provides independent election rights to the group health coverage they were enrolled in on the day prior to a "qualifying event."
